Go Loyalty Terms of Use

These Terms of Use (“Terms”) are a legally binding agreement between you (“you” or the “User”) and Petrosoft, LLC (“Petrosoft,” “Company,” “we,” or “us”), the provider of the Go Loyalty mobile application and related services (collectively, the “Service” or “App”). By downloading, accessing, or using Go Loyalty, you agree to be bound by these Terms and by our Privacy Policy (which is incorporated herein by reference). If you do not agree to these Terms, do not use the App.

Please read these Terms carefully, as they affect your legal rights and obligations. They include important limitations on liability and a clause governing the resolution of disputes. They also incorporate our Privacy Policy by reference.

1. Acceptance of Terms and Account Registration

Eligibility: By using Go Loyalty, you represent that you are at least 18 years of age and fully capable of entering into a binding contract with Petrosoft. The Service is intended solely for adult users; we do not knowingly permit individuals under 18 to create accounts or use Go Loyalty. If you are under 18 years old, you must not use or attempt to register for the App. If we become aware that a user is under 18, we reserve the right to suspend or terminate the account. (Note: The Service also contains content restricted to age 21+; see Section 3 below regarding additional age requirements for certain features.)

Account Creation: To access loyalty offers and other features, you will need to create an account by registering with your mobile phone number. You are responsible for providing accurate, current information during registration. You should only register phone numbers that you own or have the legal right to use. We may verify your number by sending a one-time code via SMS; by entering the code, you confirm your ownership of that number.

Account Security: You are responsible for maintaining the confidentiality of any authentication credentials (such as verification codes or device passcodes) and for restricting access to your mobile device where the App is installed. You agree to accept responsibility for all activities that occur under your Go Loyalty account. If you suspect that anyone has gained unauthorized access to your account or you receive an authentication code you did not request, you must notify us immediately and refrain from further using the account until the issue is resolved. Petrosoft is not liable for any loss or damage arising from your failure to safeguard your account credentials or device.

One Account Per User: Each user should maintain only one Go Loyalty account. Creating multiple accounts for the same person, or creating an account using false identity information, is prohibited and may result in account termination and loss of loyalty rewards.

Consent to Communications: By creating an account, you consent to receive communications from Petrosoft electronically, including in-app notifications and SMS messages sent to your verified phone number. Participating retailers may also send you push notifications within the App (such as promotions or store updates). These promotional communications are provided directly by retailers or offer sponsors, not by Petrosoft, and Petrosoft is not responsible for their content. You may disable promotional notifications in your device or App notification settings. Some essential communications—such as verification codes, security alerts, and legal notices—are required to operate the Service and cannot be opted out of while your account remains active.

2. Overview of Go Loyalty Service

Go Loyalty is a mobile loyalty platform that allows users to view and activate special promotional offers (“Offers”) from participating product manufacturers and redeem those offers at participating retail stores (such as convenience stores and gas stations connected to Petrosoft’s network). The Offers may include discounts, coupons, rewards, or other incentives on products available at those retail locations.

How It Works: Users can browse available Offers in the App, which may be redeemable at participating convenience stores or gas stations that are part of the loyalty program. When you tap on an Offer, you can view its full terms and conditions, including any age restrictions or redemption details. To redeem an Offer, you visit a participating store and complete any required purchase. The store can apply the discount or reward at the point of sale based on your loyalty identifier or other eligibility criteria, in accordance with the Offer’s terms.

No Fees: Go Loyalty is free to download and use. The Offers provided are complimentary incentives. We do not charge users for participating in the loyalty program, and there are no in-app purchases required for Offer redemption.

Relationship with Retailers and Manufacturers: Petrosoft itself is not the merchant or manufacturer of the products offered. We act as a platform provider facilitating the promotions between product manufacturers (“Offer Sponsors”) and you, the consumer, often in coordination with participating retailers. We do not sell you the products — any purchase you make to redeem an Offer is solely between you and the retail store where you buy the product. Similarly, any benefits (like discounts) are funded by the Offer Sponsor. Petrosoft is not an agent of the retailer or the manufacturer for purposes of the sale; we are a service provider enabling the loyalty program.

Please note that when you redeem an Offer at a store, you are subject to the store’s own terms of sale and policies (for example, store return policies, rules about sales of age-restricted products, etc.). Go Loyalty’s role is limited to providing the digital mechanism for the Offer.

Acceptance of Privacy Policy: Our Privacy Policy describes how we collect, use, and share your personal information in connection with Go Loyalty. By accepting these Terms or using the App, you also acknowledge that you have read and understood the Privacy Policy and agree to its terms. If you do not agree to the Privacy Policy, you must discontinue use of the Service.

3. Age Restrictions and Verification (21+ Offers)

Minimum Age to Use the App: You must be an adult (18 or older) to register and use Go Loyalty. As stated above, we do not permit use by minors. By accepting these Terms, you affirm that you are at least 18 years old and legally competent to use the Service and to enter into this agreement.

21+ Restricted Offers: Some Offers available through Go Loyalty pertain to products that are legally restricted to consumers of a certain age. These Offers will be clearly designated in the App (e.g., marked as “21+” content). In order to access and activate such Offers, you must verify that you are 21 or older. Go Loyalty uses a third-party service (AgeChecker.net) to perform electronic age verification in compliance with applicable laws and manufacturer requirements.

Age Verification Process: If you attempt to view or activate a 21+ Offer, the App will prompt you to complete a one-time age verification. This process will require you to provide certain personal information through AgeChecker.net. By undergoing age verification, you agree to provide true and accurate information and to comply with the verification procedure. You also consent to our use of the verification results as described in the Privacy Policy. If you do not pass the age verification (or choose not to complete it), you will be denied access to age-restricted Offers.

Petrosoft does not itself collect the data you provide during verification, but we receive confirmation of your eligibility. We rely on the third-party verification result as conclusive evidence of your age qualification for the purpose of unlocking 21+ content.

False Information: Providing false information or attempting to bypass the age verification system is a serious violation of these Terms. If we suspect that you have falsified your age or identity (for example, using someone else’s ID or a fake ID), we may terminate or suspend your account without notice. Additionally, such attempts might be flagged to the relevant offer sponsor or authorities, especially if they involve potential fraud or illegal purchase of restricted products by minors.

Compliance with Law: All age-restricted Offers are subject to verification at the point of redemption, regardless of any indication within the App. Even if an Offer is visible to you in the App, redemption requires in-person compliance with applicable age restrictions. Participating retailers may, and often must, request valid government-issued photo identification at the time of purchase to confirm eligibility for age-restricted products (e.g., tobacco or alcohol). You are required to comply with all local, state, and federal laws when attempting to redeem such Offers. By using the Go Loyalty App, you agree not to attempt to redeem any age-restricted Offer if you are not legally eligible to do so. We disclaim any liability for misuse of the App or circumvention of age restrictions (see Section 10 on Limitation of Liability).

4. License Grant and App Use Restrictions

License Grant: Subject to your compliance with these Terms, Petrosoft grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Go Loyalty app on your personal mobile device for your own non-commercial use, solely to access loyalty offers and participate in the program. Use must comply with applicable platform rules (e.g., Apple App Store or Google Play Terms of Service).

Prohibited Uses: You agree not to:

  • Tamper or Circumvent: Interfere with security features, access non-public areas, or use any system, software, or device to disrupt the Service.
  • Fraud or Misuse: Create multiple accounts, use bots or scripts, falsify loyalty activity, spoof your location, or otherwise manipulate the app or offers.
  • Transfer or Sell Offers: Offers are non-transferable unless expressly stated. You may not sell, reproduce, or misuse any offer or reward.
  • Unlawful Activity: Use the app for any illegal or unauthorized purpose, including transmitting harmful or offensive content.
  • Abuse Network Resources: Launch denial-of-service attacks, introduce malware, or overload our systems.
  • Infringe Intellectual Property: Remove or alter any trademarks or rights notices, or misuse Petrosoft’s or third-party brand assets.
  • Violate Third-Party Terms: Use the app in violation of mobile app store policies, wireless service agreements, or integrated third-party service terms.

Violation of any of the above may result in suspension or termination of your account and reporting to law enforcement where applicable.

5. Loyalty Offers and Third-Party Content

Offers Provided by Third Parties: The promotional offers available through Go Loyalty are provided by third-party retailers, product manufacturers or vendors, not by Petrosoft itself. Petrosoft facilitates the display and activation of these offers, but we are not the party making the offer to you; the manufacturer is. Each Offer may come with specific terms, conditions, or restrictions set by the manufacturer (or by applicable law). For example, an offer might have a limit of one per customer, an expiration date, require the purchase of certain quantities, or only be valid in certain locations or states. It is your responsibility to read any details provided in the App about an Offer before activating or redeeming it. By redeeming an Offer, you agree to any additional terms attached to that Offer.

No Endorsement: Display of any third-party brand or Offer in the App does not imply any endorsement of that brand by Petrosoft, nor an endorsement of Petrosoft by that third party. We provide the platform for these promotions but are not guaranteeing any product quality or the availability of any Offer beyond what the sponsor provides.

Offer Availability and Accuracy: While we strive to keep offer information up-to-date, we do not guarantee that any particular Offer will be available or honored in all cases. Offers may be subject to availability of the product at the retailer, and there may be situations where a retailer is unable to honor an Offer (for example, if a product is out of stock, if the promotion period ended, or if there was a system error). Petrosoft is not liable for any losses or disappointment arising from an Offer being unavailable or a retailer’s failure to honor the advertised promotion. The information and content related to Offers are provided by the Offer sponsors or derived from their instructions, and while we attempt to display them accurately, we cannot guarantee that all offer descriptions, pricing, or other content will be error-free or complete.

Redemption Process: To redeem an activated Offer, you will generally need to purchase the relevant product at a participating store and identify yourself as a loyalty member. Depending on the store’s system, this may involve giving your loyalty account identifier (e.g., your phone number) at checkout. The exact redemption mechanism may vary by retailer. You agree to follow the instructions provided in the App or by the store for redeeming Offers. If you have any issue redeeming an Offer (e.g., the discount doesn’t apply correctly), you should inform the store cashier or manager at the time of purchase. Petrosoft may not be able to adjust a transaction after the fact, but you can contact us to report issues and we will work with the sponsor or retailer to address them if possible.

No Cash Value & No Liability for Products: Offers have no cash value and cannot be exchanged for cash. They are promotional in nature. Petrosoft is not responsible for the actual products or services obtained using the Offers. Any purchase you make is solely between you and the retailer, and any product warranties or guarantees are provided by the product manufacturer, not by Petrosoft. We make no warranties regarding the quality, safety, or suitability of any product obtained through an Offer. Any issues or defects with the product itself should be resolved with the product’s manufacturer or the retailer per their policies. For example, if you redeem an offer for a beverage and the product is defective, that is a matter for the store or manufacturer – Petrosoft’s only role was providing the discount mechanism, and we cannot issue product refunds or replacements.

Information Sharing with Offer Sponsors: By activating or redeeming an Offer, you acknowledge and agree that Petrosoft will share certain data about that event with the third-party Offer sponsor (the manufacturer) as necessary for program administration. Specifically, we may share your loyalty user ID, confirmation of the offer redemption, the store location, and timestamp (as described in the Privacy Policy). This is done to allow the sponsor to validate the promotion and, if applicable, reimburse the retailer. The data shared does not include your name or phone number, but it does serve as a unique record of your participation. (See Privacy Policy for more details.)

Third-Party Links and Content: In the course of using the App, you might encounter links or content that lead to third-party services. For example, an Offer detail might include a link to the manufacturer’s website for more information or terms. Additionally, we might provide a button to open a maps app or navigation to a store (which uses a third-party mapping service). Any third-party content or links are provided for your convenience. We do not control and are not responsible for third-party content or websites. If you choose to visit or use any third-party links, you do so at your own risk and should review their terms of use and privacy policies.

Participating Retailers: Go Loyalty works only at certain participating retail locations. We strive to list accurate information on which stores participate (the App’s location finder will typically show stores that are in our network). However, the list of participating stores can change. A store might cease participation or new ones might be added. We do not guarantee that a given store you expect will always honor Go Loyalty offers. Always check the App for the nearest participating store and any notes about specific retailer involvement. If you attempt to redeem at a non-participating store, the offer will not work.

Changes to Offers: Offer sponsors have the right to modify or withdraw their Offers at any time (though generally within constraints of consumer protection laws). Petrosoft may also remove or suspend an Offer if we suspect misuse or if directed by the sponsor. We will do our best to reflect current Offer availability in the App. However, if an Offer is terminated early or changed, Petrosoft will not be liable for not having provided notice, beyond updating the App.

Void Where Prohibited: Any Offer made available via Go Loyalty is void where prohibited by law. If a particular promotion or product is not lawful in a certain area, the Offer is considered void in that area. For example, if a state bans certain tobacco promotions, any such offers will not be valid for redemption in that state (even if the App inadvertently displays them due to location determination issues). It is your responsibility to comply with your local laws when using the App and redeeming Offers.

6. Intellectual Property Rights

Petrosoft’s Intellectual Property: The Go Loyalty app, including all content, information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are the intellectual property of Petrosoft or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property or proprietary rights laws. Petrosoft, Go Loyalty, and associated logos are trademarks/service marks of Petrosoft (or its affiliates) where applicable.

We grant you a limited license to use the App as set forth in Section 4. This does not grant you any ownership or intellectual property rights in the App or any content provided by the Service. All rights not expressly granted to you in these Terms are reserved by Petrosoft and its licensors. You must not reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, or transmit any of the material from our App except as explicitly allowed by us. For example, you may display on your device and privately use the content for your personal, non-commercial purposes, but you cannot copy or scrape the Offers or database to use elsewhere.

Third-Party Trademarks and Content: Many of the names, logos, product and service names, and designs appearing within the App (such as those of manufacturers or stores) are trademarks or copyrights of their respective owners. All third-party trademarks (like brand logos of products) remain property of their owners. Petrosoft uses them within Go Loyalty solely to identify the third parties’ products and offers for your informational benefit, under what is generally considered nominative or descriptive use in commerce. Such use is not meant to imply any sponsorship or endorsement by those third parties, except that they are participants in the loyalty program. You are not granted any rights to use any third-party content outside of the context of the App. If you, for instance, see a manufacturer’s logo in the App, you may not extract and reuse that logo for any purpose outside the App.

Copyright Policy: If you believe that any content in the App infringes your copyright or other intellectual property rights, please notify us promptly with specific details (you can use the contact info below). Petrosoft respects intellectual property rights and will remove content that is found to infringe upon valid rights. Because most content in the App is provided by Petrosoft or participating businesses, copyright infringement is unlikely, but we will address any legitimate concerns.

Intellectual Property Claims: In the event of any claim that the Go Loyalty App or your possession and use of the App infringes a third party’s intellectual property rights, Petrosoft (and not Apple or Google) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. You agree to notify us immediately if you receive any such claim, and to not involve Apple or Google in such matters. (This is further detailed in the Platform Terms section below.)

7. User Conduct and Community Standards

(Note: Currently, Go Loyalty does not have social features like messaging, content posting, or forums. If such features are added in the future, this section would govern user content and conduct in that context.)

When using the Service, you agree to behave in a respectful and lawful manner. You must not misuse interactive features (if any are introduced) or harass other users or staff. You also agree not to attempt to manipulate the loyalty program (for example, by using scripts or exploiting bugs to obtain benefits). If you discover a bug or exploit, you agree to report it to Petrosoft rather than using it for personal gain.

We reserve the right to monitor any communications or content on the Service and to remove any content (or take action against any account) that we find violates these Terms or any law, or that we deem abusive or disruptive to the Service or other users.

8. Termination and Suspension

Termination by You: You may stop using Go Loyalty at any time. You also have the right to terminate your account (delete your account) at any time, as described in the Privacy Policy. Termination of your account means you will no longer have access to the App. If you wish to terminate these Terms, you can simply discontinue use of the App and, if desired, uninstall it from your device. However, the obligations and rights that by their nature should survive termination (such as disclaimers, limitations of liability, governing law, etc.) will continue to apply even after you stop using the Service.

Termination or Suspension by Petrosoft: We reserve the right, in our sole discretion, to suspend or terminate your account or access to the Service at any time with or without notice, if we believe that: – You have violated any provision of these Terms or have otherwise misused the Service (for example, engaging in fraud, abuse of offers, or illegal conduct). – We are required to do so to comply with a legal requirement or court order. – We are discontinuing the Go Loyalty service or it becomes impractical to continue (for instance, if a partner withdraws support and we cannot operate). – There is an unexpected technical or security issue, or we suspect unauthorized or fraudulent activity in your account.

In some cases, we may suspend your access rather than terminate it, if an issue is temporary or potentially resolvable (e.g., if we detect unusual activity, we might suspend pending your clarification). During a suspension, you will not be able to access your account or Offers.

If your account is terminated—whether by you or by Petrosoft—your right to use the Service ends immediately. We may deactivate or delete your account and related data associated with the Go Loyalty app, subject to any retention described in our Privacy Policy. However, please note that Petrosoft cannot delete purchase or transaction data maintained independently by participating retailers; such information is governed by those retailers’ own data practices. We are not liable to you or any third party for account termination or access revocation, provided it is done in accordance with these Terms and applicable law.

Effect on Offers: If your account is terminated or suspended, you will lose access to any unredeemed Offers or pending rewards in your account. These may be voided at our discretion, especially in cases of misuse. If termination was wrongful or in error, our responsibility would typically be to restore your account or any lost Offers; however, if termination is permanent due to your breach, you forfeit those promotional benefits.

Appeal: If you believe we have suspended or terminated your account in error, you may contact customer support to request a review. We will consider your explanation in good faith, but our decision (especially in matters concerning program integrity and legal compliance) will be final.

Even after termination of your account, sections of these Terms that by their nature should survive will remain in effect. This includes sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and others as applicable.

9. Disclaimer of Warranties

AS-IS Service: The Go Loyalty app and all services and content provided through it are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Petrosoft disclaims all warranties, express or implied, in connection with the Service and your use thereof. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App or Service will meet your requirements or achieve any intended results, or that it will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

Functionality and Accuracy: Petrosoft does not guarantee the accuracy or completeness of any information on the App (including Offer details, pricing, or store information). While we endeavor to correct known errors, use of the Service is at your own risk. You assume all responsibility for any actions you take based on information obtained through the App. If there is a mistake (e.g., an Offer is listed incorrectly), your sole remedy is to cease using that Offer and/or notify us so we can correct it.

We specifically do not warrant that: – The Service will always be available or at any particular uptime. There may be times the App is down for maintenance or due to technical issues. – Any calculations of rewards, points (if applicable), or discounts will be without error, though we will correct any errors promptly once discovered. – The results of using the Service (e.g., obtaining discounts or rewards) will be to your satisfaction, or that any offers will guarantee any particular savings or outcome.

Third-Party Responsibility: Offers are fulfilled by third parties; we make no warranty regarding the goods or services obtained through those offers. Any issues with third-party products or conduct are the responsibility of that third party. Petrosoft is not liable for third-party obligations (such as a manufacturer’s promise within an Offer).

On Behalf of Apple and Google: You acknowledge that Apple (for iOS users) and Google (for Android users) have no obligation to furnish any maintenance or support services in relation to the Go Loyalty App. To the maximum extent permitted by applicable law, Apple and Google disclaim any warranties for the App. In other words, Apple and Google provide the platforms (App Store and Play Store) but bear no responsibility for the App’s performance or compliance. Any warranties (express or implied) are provided solely by Petrosoft, not by Apple or Google. For example, if the App fails to conform to any applicable warranty and you notify Apple, Apple will have no warranty obligation with respect to the App beyond potentially refunding the purchase price (if any) of the app – but since the app is free, no refund applies. You agree that Apple and Google have disclaimed all warranties in this regard and that we are stating this on their behalf as required.

Route Guidance / Location Accuracy: If the Service includes any maps or navigation features (e.g., showing store locations or giving directions), use of any real-time route guidance or location feature is at your sole risk. Location data may not always be accurate or available; actual road conditions or device GPS accuracy can result in misleading information. Always exercise independent judgment when following directions. Petrosoft does not guarantee the accuracy of any maps or location info in the App.

No Oral or Written Info Creates Warranty: No advice or information, whether oral or written, obtained by you from us (including from customer support) shall create any warranty that is not expressly stated in these Terms. We do not warrant or endorse any specific retail store or manufacturer beyond providing their offers.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. In such cases, any implied warranties are limited to the minimum scope and duration permitted by law.

10. Limitation of Liability

Limited Liability: To the maximum extent permitted by law, in no event shall Petrosoft, its parent company, affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, including but not limited to damages for lost profits, lost savings, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Go Loyalty app or offers, however caused, regardless of the theory of liability (contract, tort, or otherwise), and even if we have been advised of the possibility of such damages.

This means that if something goes wrong with the Service – for example, you miss out on a promotion due to an App error, or your device malfunctions while using the App – Petrosoft is not responsible for paying for any costs or losses you incur (like the price difference of a missed discount, or any incidental expenses).

Cap on Direct Damages: To the extent that the above exclusion of liability is not enforceable or does not fully cover a claim, the total cumulative liability of Petrosoft and its affiliates for any direct damages arising from or related to the Service shall be limited to the greater of (a) the amount of fees you have paid to us in the 12 months prior to the event giving rise to the claim (if any), or (b) US $50.00. Since Go Loyalty is free for users, in most cases this means our liability would be capped at $50. This cap applies in aggregate to all claims by a user; multiple claims won’t enlarge the limit. The existence of multiple claims or suits will not enlarge this limit.

Third-Party Offers and Products: You specifically acknowledge that Petrosoft is not liable for the conduct of third parties, including retailers or manufacturers, and that the risk of harm or damage from them rests entirely with you. For example, if a store fails to honor an Offer or if a product you buy is defective or causes injury, those are issues to be taken up with the store or manufacturer. Petrosoft’s liability, if any, would not extend to the consequences of third-party actions. We do not assume any responsibility for transactions you enter into with retailers, even if facilitated by our Service.

No Liability for Certain Claims (Apple-Specific): You agree that Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection or similar legislation. To the extent any such claims arise, you and Petrosoft (not Apple) will be responsible for handling them. For instance, if you claim that the App did not operate as promised or violated a law, Apple has no obligation to pay damages or provide remedy – that responsibility lies with Petrosoft, subject to the limitations herein.

User Responsibility: You assume full responsibility for your use of the Service. This means you use the App at your own discretion and risk. You are responsible for any damage to your device or loss of data that results from using the App. Petrosoft tries to keep the Service free of bugs and safe, but we cannot guarantee there won’t be issues. Always take appropriate precautions (like not using the App while driving, not ignoring real-world conditions because of App content, etc.). If you are dissatisfied with the Service, your sole remedy is to stop using it (and, if applicable, terminate your account) – beyond any specific remedies that might be provided under these Terms.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain damages. If you live in such a jurisdiction, some of the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

Release: To the extent permitted by law, you release Petrosoft and its affiliates from any and all liability or responsibility for any dispute between you and any third party (e.g., a retailer or product supplier) arising out of your use of the Service. For example, if a dispute arises regarding whether a store should honor an offer or regarding the quality of a product you got via an offer, you release us from claims, demands, and damages of every kind and nature arising out of or connected with such dispute.

11. Indemnification

You agree to indemnify, defend, and hold harmless Petrosoft, its parent company, affiliates, and their respective officers, directors, employees, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms: If you breach any provision of this agreement (for example, by engaging in prohibited uses, providing false information, or otherwise violating the rules), and that breach causes us to incur costs or face claims from a third party, you will cover those costs/claims.
  • Your misuse of the Service: This includes any use of the App that is illegal or unauthorized, as well as use that results in damage to or the impairment of our rights or the rights of others. For instance, if you use the Service to commit fraud, or you harass a partner or other user through the Service, and someone sues us as a result, you will indemnify us.
  • Your violation of any law or regulation or of any third-party rights: If your conduct through the App infringes someone’s intellectual property or privacy rights, or violates an applicable law (like an illegal resale of promotions or something defamatory you communicate), you will defend and hold us harmless from the consequences.
  • Your interactions with third parties via the Service: If you have a dispute or issue with a retailer, manufacturer, or other third party (for example, you get into a legal dispute over a transaction or promotion), and Petrosoft is somehow brought into that dispute, you will indemnify us for any costs or liabilities we incur due to that.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which event you agree to cooperate with us in asserting any available defenses). You may not settle any claim that implicates any Indemnified Party or imposes any obligation on an Indemnified Party without our prior written consent.

This indemnification provision will survive termination of your account or these Terms.

12. Dispute Resolution

Informal Resolution: If you have a dispute, concern, or issue with the Service or these Terms, we encourage you to contact us first to seek an informal resolution. You can reach out to our customer support at mobile-support@petrosoftinc.com with a brief description of your concern. We will attempt to resolve the matter through good faith discussions within a reasonable time. Most user concerns can be resolved quickly and to the satisfaction of both parties in this way.

Arbitration and Venue:

Unless prohibited by law, you and Petrosoft agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted in the state or federal courts located in Allegheny County, Pennsylvania (which is where Petrosoft’s headquarters is located). You and Petrosoft consent to the exclusive jurisdiction of such courts and waive any objections to the exercise of jurisdiction over the parties by those courts and to venue in those courts (including any argument of forum non conveniens).

However, this does not limit either party’s ability to seek injunctive relief or any other equitable remedy in the appropriate jurisdiction if necessary to prevent harm (e.g., intellectual property infringement could be enjoined in any competent court).

Governing Law: These Terms and your use of the Service are governed by the laws of the Commonwealth of Pennsylvania, USA, and, to the extent applicable, U.S. federal law, without regard to its conflict of law principles. This means that we look to Pennsylvania law to interpret and enforce this contract, even if you reside elsewhere. If you are using the Service outside of the United States, be aware that you are still primarily interacting with a U.S. service governed by U.S. law.

Exception for EU Users: If you are a consumer residing in the European Union (though our Service is intended for U.S. use only), you may have the benefit of certain mandatory provisions of the law of your country of residence. Nothing in these Terms, including the governing law clause, affects your rights as a consumer to rely on such mandatory local law provisions.

Time Limit to Bring Claims: To the extent permitted by law, any claim or cause of action by you arising out of or related to use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or else be forever barred. (This does not apply to claims by Petrosoft, or where a longer period is required by law.)

Waiver of Class Actions: You and Petrosoft agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. (This clause is typical in many terms to prevent class action litigation, but ensure it’s legally enforceable in your jurisdiction. If this clause is unenforceable, it doesn’t void the rest of the dispute resolution terms.)

13. U.S. Legal Compliance (Export and Sanctions)

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. This means you are not on the U.S. Treasury Department’s Specially Designated Nationals (SDN) list, or any similar list, and you are not in a country like North Korea or Iran where U.S. law would bar us from providing you the App.

The Go Loyalty App and Service are intended for use in the United States. We do not knowingly allow usage in any region or country where the Service would violate export control laws or local laws. You agree to comply with all U.S. and foreign export laws and regulations when using the App. You shall not – directly or indirectly – export, re-export, or release the App or any related software to, or make the App accessible from, any jurisdiction or country to which export, re-export, or release is prohibited by law. By using the App, you also confirm that you will not use it for any prohibited end uses (e.g., in connection with the development of nuclear, chemical, or biological weapons or missile technology, as per U.S. export regulations).

14. Changes to These Terms

Petrosoft may modify or update these Terms of Use from time to time. If we make material changes, we will provide notice to you in a manner reasonably designed to alert you to the change. This may include posting the updated Terms within the App (with a new effective date), sending you a notification or email (if we have your contact info), or displaying a message upon your next login. The “Last Updated” date at the top of this document will indicate when the latest changes were made.

Unless we state otherwise, modifications will be effective 30 days after posting or notifying you, except changes addressing new functions of the Service or changes made for legal reasons may be effective immediately. We will endeavor to give at least 30 days’ notice of any material changes. What constitutes a “material change” is at our discretion, but typically it would be something that significantly affects your rights or obligations (for example, a change in dispute resolution mechanisms or in data usage).

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new terms, you must stop using the Service. We encourage you to review the Terms periodically to ensure you understand the terms and conditions that apply to your use of the App.

15. Miscellaneous

Entire Agreement: These Terms of Use (together with the Privacy Policy and any additional guidelines or rules that we post within the App) constitute the entire agreement between you and Petrosoft regarding the Go Loyalty Service, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service. If you and Petrosoft have entered into a separate written agreement governing your use of the Service (for example, if you were a business partner using a different mode of the service), and that agreement conflicts with these Terms, the separate agreement may prevail in its scope.

Severability: If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. In other words, we both intend that the rest of the agreement stands even if one clause is struck down, and we agree to modify any invalid term in good faith to closely achieve its original intent in a lawful way.

Waiver: No waiver of by Petrosoft of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of that term or any other term, and any failure of Petrosoft to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. For example, if we do not immediately enforce a breach of these Terms by you, we are not waiving our right to enforce it or any similar breach later.

Assignment: You may not assign or transfer these Terms (or any of your rights or obligations hereunder) without our prior written consent. Any attempt by you to do so without consent will be null and of no effect. Petrosoft may freely assign or transfer these Terms (in whole or in part) as needed (for example, to a successor entity in a merger or acquisition, or to an affiliate). These Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

No Third-Party Beneficiaries (except as stated): These Terms are for the sole benefit of you and Petrosoft, and (except as expressly provided below in the Platform Terms) they are not intended to confer any rights or remedies on any other person or entity. However, please note the following exception:

16. Additional Terms for Apple iOS Users

If you download or use the Go Loyalty App on an Apple device (iPhone or iPad), the following terms apply in addition to the Terms set out above. These terms are required by Apple Inc. (“Apple”) and are intended to apply between you, Apple, and us. (In case of any conflict between this section and other terms, this section prevails for iOS users.)

  • Acknowledgment: You acknowledge that these Terms are concluded between you and Petrosoft only, not with Apple, and that Petrosoft (not Apple) is solely responsible for the Go Loyalty App and its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded devices that you own or control and as permitted by the Usage Rules set forth in the App Store Media Services Terms of Service. In other words, you may use the App on your iPhone/iPad, but not in any way that contradicts Apple’s usage guidelines (for example, not on devices you don’t own, and not outside of Apple’s allowed environments).
  • Maintenance and Support: Petrosoft is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  • Warranty: To the extent that any warranty is implied by law that cannot be disclaimed, if the App fails to conform to any such warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty are Petrosoft’s responsibility, as further set out in these Terms. However, we have disclaimed all warranties to the extent permitted (see Section 9 above), so aside from refunding any purchase price (the app is free), there are no additional warranties.
  • Product Claims: You acknowledge that Petrosoft, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App. This includes, but is not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Apple has no responsibility for such claims.
  • Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Petrosoft (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. (This reiterates Section 6 regarding IP claims.)
  • Legal Compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or has been designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties (as we also stated in Section 13). This is required by Apple as well.

  • Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the App. For example, if your use of the App is subject to any wireless data service agreement or if you use a VoIP app concurrently, you must not violate those agreements when using our App. Also, use of AgeChecker.net or any maps may be subject to their terms of service which you agree to follow.
  • Third-Party Beneficiary: As noted, Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms for the iOS version of the App. Upon your acceptance of these Terms, Apple shall have the right to enforce these Terms against you as a third-party beneficiary. (There are no third-party beneficiaries for the Android version explicitly, but Google may have similar rights under its policies.)

These additional terms do not change any provisions of the main Terms except as required to comply with Apple’s App Store policies. All other terms of the agreement (including limitations of liability and warranty disclaimers) apply to your use of the App on iOS devices.
